By commissioning work, placing an order, or making a purchase, clients explicitly acknowledge that they have read, understood, and accepted these terms as legally binding.
These Terms define the scope of services, outline the rights and responsibilities of both parties, establish the limitations of liability, and set forth the rules governing ownership, permitted usage, and distribution of all delivered creative works. They are designed to ensure transparency, maintain the highest standards of professional conduct, and provide legal protection for both D4VGFX Lab and the client. It is the responsibility of each client to review these Terms thoroughly prior to engaging in any project or purchase, to ensure complete understanding and agreement.

2. INTELLECTUAL PROPERTY & LICENSES
All creative works produced by D4VGFX Lab, including but not limited to concept sketches, drafts, proofs, final artworks, and source files, remain the exclusive property of D4VGFX Lab until full payment has been received and processed. Only upon receipt of full payment is the client granted a perpetual license to use the work exactly as outlined in the invoice or contract.
Licenses may be personal (for private, non-commercial purposes) or commercial (for business, marketing, or promotional use), depending on the agreement. This ensures that clients can enjoy legal and authorized use of the creative works while protecting the intellectual property rights of the studio.
Unless a separate copyright transfer or exclusive buyout has been explicitly negotiated and documented in writing, D4VGFX Lab retains the right to display, promote, reuse, and showcase the work in its portfolio, on social media, and for other marketing purposes. Clients are strictly prohibited from reselling, relicensing, redistributing, or transferring the work to any third party without explicit written permission from D4VGFX Lab. Any unauthorized use may result in legal action and enforcement of intellectual property rights.
At D4VGFX Lab, we take ownership and protection of our creative works seriously, ensuring both clients and the studio can collaborate confidently and securely while maintaining the highest standards of professionalism and integrity.
3. ORDERS & PAYMENTS
Accepted payment methods on D4VGFX Lab include PayPal — with the possibility to pay in 3 installments — ApplePay (available if the client’s device supports this payment method), or Credit / Debit Card. At the time of payment through PayPal, the platform provides a text field which cannot be left empty; the client is required to enter all necessary information to ensure the work is executed effectively and achieves excellent results.
All orders are considered confirmed and work will commence only upon receipt of payment from the client. D4VGFX Lab will not begin any project before the payment has been received. To accelerate the process, the client is required to contact D4VGFX Lab using the available communication channels on the website — including Instagram, WhatsApp, or email — and attach the payment receipt along with all necessary information needed to complete the final product.
Regarding quotes or project proposals, clients must contact D4VGFX Lab directly. All communications should be clear, complete, and timely to ensure accurate scope assessment, efficient execution, and maintenance of high professional standards. Any incomplete information or delays in communication may affect project timelines and quality of deliverables.
4. REVISIONS
The number of revisions included in a project depends on the type of product purchased by the client. Each product or package clearly indicates the revision allowance. Minor revisions that fall within the original scope of the project and within the included revision allowance will be implemented during the production phase.
If additional revisions are required beyond the included allowance, the client has both the right and the obligation to request them, provided they are purchased separately before the completion of the work. Once the project is formally declared finished by the client or D4VGFX Lab, no further revisions or modifications will be accepted under any circumstances.
Any major changes — such as significant alterations to the original brief, complete rework of the project, or addition of new deliverables — are considered out-of-scope. In such cases, the client is not only entitled but also required to pay an extra fee as specified in the quote or by mutual agreement. This ensures that both D4VGFX Lab and the client maintain clear expectations and fair compensation for additional work.
5. FILE DELIVERY
Final deliverables are generally provided in the formatsJPG, JPEG, PNG, PDF, and SVG. If the client requests the raw files — such as Adobe Illustrator (.AI) or Photoshop (.PSD) — they are required and obligated to pay an additional fee to obtain these source files, unless explicitly included in the purchased package or service.
Delivery times vary depending on the item purchased, the complexity of the project, the number of revision cycles, any modifications to the project scope, and the response times between the client and D4VGFX Lab. For any eventuality, D4VGFX Lab is required and obligated to notify the client, who has the right to receive such notifications regarding changes, delays, or important project updates.
All files delivered are compatible with the majority of widely used software and adhere to professional quality standards, ensuring that the client receives reliable and production-ready creative assets suitable for their intended use.
6. REFUNDS & CANCELLATIONS
All payments made to D4VGFX Lab are generally considered non-refundable, except in exceptional and documented circumstances that are agreed upon by both parties. If a client chooses to cancel a project prior to completion, any work that has already been completed will be charged proportionally, and the client will receive the corresponding deliverables that have been produced up to that point.
In the event that D4VGFX Lab cancels a project or is unable to deliver the agreed services, the client will receive a refund for the undelivered portion of the project. It is important to note that if the payment was made via PayPal, the platform fees/commissions retained by PayPal cannot be refunded, meaning the client will receive the full amount paid minus any PayPal transaction fees. Therefore, a 100% net refund is not always possible due to these third-party fees.
For interrupted projects, partial refunds or partial deliverables are calculated based on the time invested, milestones completed, and resources allocated. All refund calculations will always be transparent and clearly communicated to the client to maintain professional trust and fairness. Cancellations and refunds are handled promptly and in accordance with these Terms & Conditions, ensuring both D4VGFX Lab and the client have a clear understanding of obligations and outcomes.
7. LIABILITY
D4VGFX Lab guarantees that all delivered work will adhere to the highest professional quality standards and will be free from material defects that could impact the intended use. While D4VGFX Lab ensures meticulous attention to detail and rigorous quality control, the studio does not assume responsibility for any misuse of delivered materials, unintended or alternative applications, or any external results that fall outside the scope of the project.
Specific commercial outcomes, such as increased sales, improved marketing performance, or other measurable business metrics, cannot be guaranteed. The client is solely responsible for verifying that all provided materials comply with intellectual property laws and do not infringe upon the rights of any third parties.
To the maximum extent permitted by law, the liability of D4VGFX Lab is strictly limited to the fees paid for the project in question. This ensures a clear and fair understanding between D4VGFX Lab and the client, maintaining professional trust while protecting both parties from unforeseen issues or claims beyond the agreed scope. All projects are executed with precision, accountability, and adherence to the highest industry standards, reinforcing D4VGFX Lab’s commitment to reliable, high-quality creative services.
8. POST-SALE SUPPORT
Post-sale support at D4VGFX Lab is available immediately after the purchase or request of a specific product or item and does not extend beyond the completion and delivery of the work, as the project concludes at that point. The support service is active on Mon–Wed & Fri: 10:00–17:00 and Thu: 10:00–12:00 (Europe/Rome timezone), ensuring structured and predictable availability for clients.
Clients have the right and are encouraged to contact D4VGFX Lab for any issues or clarifications regarding the delivered products or project assets. D4VGFX Lab is obliged and committed to respond promptly via the available communication channels, including Instagram, WhatsApp, and Email, maintaining professional trust and ensuring transparent, reliable service.
It is important to note that any post-work activities that fall outside the scope of the completed project cannot be included in the original work and must be treated as a separate service. Such additional work is subject to payment obligations, which the client is required and obliged to honor. Clients are strongly encouraged to report any issues promptly in order to guarantee a fast, fair, and effective resolution, ensuring that all support interactions are handled professionally and efficiently.
9. CHANGES TO THE TERMS
D4VGFX Lab reserves the right to update or amend these Terms & Conditions at any time to ensure continued compliance with legal requirements, reflect industry best practices, or adapt to evolving business needs. Any significant or material changes will be clearly published on the website, with the date of the last update prominently displayed at the top of the page for full transparency.
